Welcome to the website of Harvest Construction ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of www.harvestconstruction.biz (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

They do not replace or override any separate written contract, estimate, or agreement you sign with Harvest Construction for actual construction, renovation, or design services — those projects are governed by the specific signed agreement for that project.

  • Attempt to gain unauthorized access to the Site, our servers, or any connected systems

  • Introduce viruses, malware, or other harmful code

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

  • Submit false or misleading information through our contact/estimate forms

We reserve the right to restrict or terminate your access to the Site at our discretion, without notice, for conduct we believe violates these Terms or is otherwise harmful to us, other users, or third parties.

2. No Professional Advice / Informational Purposes Only

Content on the Site (including blog posts, project galleries, FAQs, and general renovation information) is provided for general informational purposes only and does not constitute professional construction, engineering, architectural, financial, or legal advice specific to your property or project. Every project has unique conditions (structural, code, permitting, site-specific), and you should not rely solely on general Site content when making decisions about your property. Actual project scope, cost, timeline, and recommendations will be provided through a formal, signed estimate or contract following an in-person or documented assessment.

3. Estimates and Quotes

Any estimate, quote, or project cost range provided through the Site (including online forms or calculators, if offered) is preliminary and non-binding. Final pricing, scope, and terms will be set out in a separate written contract. Estimates are subject to change based on site conditions, material costs, permitting requirements, and project scope discovered after an in-person assessment.

4. Intellectual Property

All content on the Site — including text, graphics, logos, photographs (including before/after project photos), and website design — is the property of Harvest Construction or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

Project photographs displayed on the Site are used with client consent where required, and remain the property of Harvest Construction unless otherwise agreed in writing.

5. Third-Party Links

The Site may contain links to third-party websites (e.g., review platforms, social media, supplier sites) for your convenience. We do not control and are not responsible for the content, privacy practices, or terms of any third-party site. Use of third-party sites is at your own risk and subject to their own terms.

6. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Any warranties related to actual construction or renovation work performed by Harvest Construction are governed exclusively by the signed contract for that project, not by this Site or these Terms.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HARVEST CONSTRUCTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify and hold harmless Harvest Construction, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site or violation of these Terms.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, unless otherwise required by applicable consumer protection law in your jurisdiction (see Section 11 regarding EU/UK and California residents). Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Maryland, unless applicable law requires otherwise.

11. Additional Terms for California, EU, and UK Residents

EU/UK residents: If you are accessing the Site from the EU or UK, nothing in these Terms limits any statutory rights you have under the EU Digital Services Act, UK Consumer Rights Act 2015, or other applicable consumer protection law that cannot be excluded by contract. To the extent any provision of these Terms conflicts with a mandatory consumer protection law in your jurisdiction, the mandatory law will control for that provision only, and the remainder of these Terms remains in effect.
